Welcome to Stormviax Forecast ("Stormviax," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and any related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Stormviax Forecast. We recommend that you read these Terms carefully, as they contain important information regarding your legal rights, remedies, and obligations.

1. Acceptance of Terms

By creating an account, accessing, browsing, or using any part of the Stormviax Forecast Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any additional terms and conditions that are referenced herein or that may apply to specific features of the Services. These Terms apply to all visitors, users, and others who access or use the Services. Your continued use of the Services after any modifications to these Terms signifies your acceptance of the updated Terms. If you are accessing or using the Services on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and in such case, "you" and "your" will refer to that entity.

  • "Services" refers collectively to the Stormviax Forecast website, mobile applications, any associated software, data, content, tools, features, and functionalities provided by Stormviax Forecast.

  • "Content" refers to all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials, whether publicly posted or privately transmitted.
  • "User Content" refers to Content that a User posts, uploads, publishes, submits, or transmits through the Services, including but not limited to storm reports, photos, comments, and feedback on the "Viax Feed."
  • "Intellectual Property Rights" refers to patents, copyrights, trademarks, trade secrets, and any other proprietary rights recognized in any jurisdiction.
  • "Personal Information" refers to any information that identifies, relates to, describes, or is capable of being associated with, a particular individual, as described in our Privacy Policy.
  • "Third-Party Services" refers to services or content provided by entities other than Stormviax Forecast that may be integrated with or linked from our Services.

3. Access and Use of Services

3.1. Eligibility

You must be at least 13 years old to use the Stormviax Forecast Services. By using the Services, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into a binding agreement with Stormviax Forecast. If you are under 18, you represent that you have reviewed these Terms with your parent or legal guardian and that they agree to these Terms on your behalf. We do not knowingly collect personal information from children under 13.

3.2. License to Use Services

Subject to your compliance with these Terms, Stormviax Forecast grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use. This license is granted solely for the purpose of enabling you to use and enjoy the benefit of the Services as provided by Stormviax Forecast, in the manner permitted by these Terms.

3.3. Service Availability

While we strive to ensure that the Services are available 24/7, Stormviax Forecast does not guarantee uninterrupted or error-free operation of the Services. We may, at our sole discretion, suspend, withdraw, discontinue, or change all or any part of our Services without notice. We will not be liable to you if for any reason our Services are unavailable at any time or for any period.

3.4. Accuracy of Information

The weather forecasts, alerts, and other information provided through the Services are for informational purposes only. While we employ advanced AI and meteorological models, weather is inherently unpredictable, and actual conditions may vary. Stormviax Forecast does not warrant the accuracy, completeness, or reliability of any information provided. You acknowledge that any reliance on such information is at your own risk. Always consult official government weather warnings and emergency services in critical situations.

4. User Accounts

4.1. Account Creation

Some features of the Services, such as saving locations in "StormVault" or receiving personalized alerts, may require you to create an account. When creating an account, you agree to provide accurate, current, and complete information as prompted by the registration form. You also agree to maintain and promptly update your account information to keep it accurate, current, and complete.

4.2. Account Security

You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify Stormviax Forecast immediately of any unauthorized use of your account or any other breach of security. Stormviax Forecast will not be liable for any loss or damage arising from your failure to comply with this security obligation. We strongly recommend using a strong, unique password and enabling multi-factor authentication if available.

4.3. Account Termination

Stormviax Forecast reserves the right to suspend or terminate your account and your access to the Services at our sole discretion, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may do so by following the instructions within the Services or by contacting us.

5. User Conduct and Responsibilities

5.1. Prohibited Uses

You agree not to use the Services for any purpose that is unlawful or prohibited by these Terms. Without limiting the generality of the foregoing, you agree not to:

  • Use the Services in any manner that could damage, disable, overburden, or impair any Stormviax Forecast server, or the network(s) connected to any Stormviax Forecast server, or interfere with any other party's use and enjoyment of any Services.
  • Attempt to gain unauthorized access to any Services, other accounts, computer systems, or networks connected to any Stormviax Forecast server or to any of the Services, through hacking, password mining, or any other means.
  • Obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.
  • Use the Services to transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Upload, post, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Upload, post, transmit, or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
  • Upload, post, transmit, or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
  • Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies, or regulations of networks connected to the Services.
  • Violate any applicable local, state, national, or international law or regulation.
  • Engage in any activity that is harmful to minors.
  • Collect or store personal data about other users without their express consent.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services, use of the Services, or access to the Services without the express written permission of Stormviax Forecast.

5.2. User Content

By submitting User Content to the Services (e.g., via the "Viax Feed"), you grant Stormviax Forecast a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Services and Stormviax Forecast's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels.

You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish User Content you submit; and that the User Content, and Stormviax Forecast's use of the User Content as permitted by these Terms, will not infringe, misappropriate, or violate a third party’s intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

You are solely responsible for your User Content and the consequences of posting or publishing it. Stormviax Forecast does not endorse any User Content or any opinion, recommendation, or advice expressed therein, and Stormviax Forecast expressly disclaims any and all liability in connection with User Content.

Stormviax Forecast reserves the right to remove any User Content at any time, without prior notice, for any reason, including if it violates these Terms or is otherwise objectionable.

6. Intellectual Property Rights

6.1. Stormviax Forecast Content

All intellectual property rights in and to the Services and all Content provided by Stormviax Forecast (excluding User Content), including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Stormviax Forecast or its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You may not use, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content on our Services, except as generally permitted through the normal functionality of the Services or as expressly authorized by these Terms.

6.2. Trademarks

The Stormviax Forecast name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Stormviax Forecast or its affiliates or licensors. You must not use such marks without the prior written permission of Stormviax Forecast. All other names, logos, product and service names, designs, and slogans on these Services are the trademarks of their respective owners.

6.3. Feedback

If you provide Stormviax Forecast with any feedback, suggestions, comments, or ideas regarding the Services ("Feedback"), you hereby grant Stormviax Forecast a perpetual, irrevocable, worldwide, royalty-free, fully paid, non-exclusive, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Feedback in connection with the Services and Stormviax Forecast's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Services (and derivative works thereof) in any media formats and through any media channels. You acknowledge that you are not entitled to any compensation or reimbursement of any kind from Stormviax Forecast for any Feedback.

7. Disclaimers (No Warranties)

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, STORMVIAX FORECAST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

STORMVIAX FORECAST DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. STORMVIAX FORECAST DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE SERVICES IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE. YOU (AND NOT STORMVIAX FORECAST) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

THE WEATHER FORECASTS AND RELATED INFORMATION PROVIDED BY STORMVIAX FORECAST ARE BASED ON COMPLEX METEOROLOGICAL MODELS, DATA, AND AI ALGORITHMS. WHILE WE STRIVE FOR HIGH ACCURACY, WEATHER IS INHERENTLY UNPREDICTABLE AND CAN CHANGE RAPIDLY. THEREFORE, STORMVIAX FORECAST DOES NOT WARRANT THAT THE FORECASTS WILL BE ACCURATE, COMPLETE, OR UP-TO-DATE AT ALL TIMES, NOR DOES IT GUARANTEE THAT ANY SPECIFIC WEATHER EVENT WILL OR WILL NOT OCCUR AS FORECASTED. YOU ACKNOWLEDGE THAT RELIANCE ON ANY INFORMATION PROVIDED THROUGH THE SERVICES IS SOLELY AT YOUR OWN RISK. ALWAYS CONSULT OFFICIAL GOVERNMENT WEATHER WARNINGS AND EMERGENCY SERVICES IN SITUATIONS OF SEVERE WEATHER OR IMMEDIATE DANGER. STORMVIAX FORECAST IS NOT RESPONSIBLE FOR ANY DECISIONS YOU MAKE BASED ON THE INFORMATION PROVIDED BY THE SERVICES.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STORMVIAX FORECAST, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES.

THIS LIMITATION OF LIABILITY APPLIES REGARDLESS OF THE LEGAL THEORY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT STORMVIAX FORECAST HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF STORMVIAX FORECAST, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, STORMVIAX FORECAST'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to defend, indemnify, and hold harmless Stormviax Forecast, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms of Service.
  • Your use of the Services, including, but not limited to, your User Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms.
  • Your negligence or willful misconduct.
  • Your violation of any rights of another party.
  • Any claim that your User Content caused damage to a third party.

Stormviax Forecast reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Stormviax Forecast in asserting any available defenses. This indemnification obligation will survive these Terms and your use of the Services.

10. Third-Party Links and Services

The Services may contain links to third-party websites, applications, or services that are not owned or controlled by Stormviax Forecast. These links are provided for your convenience and informational purposes only. For example, our "The Surge Blog" may feature links to external scientific research, news articles, or other resources.

Stormviax Forecast has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not endorse or make any representations about them, or any information, software, or other products or materials found there, or any results that may be obtained from using them. If you decide to access any of the third-party websites linked to our Services, you do so entirely at your own risk and subject to the terms and conditions of use for such websites.

You acknowledge and agree that Stormviax Forecast shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. 11. Termination

11.1. Termination by Stormviax Forecast

We may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Examples of reasons for termination include, but are not limited to, violation of our User Conduct policy, fraudulent activity, or any other activity that we, in our sole discretion, deem harmful to Stormviax Forecast, its users, or third parties.

11.2. Termination by You

You may terminate your account at any time by following the instructions within the Services or by contacting us directly. Upon termination of your account, your right to use the Services will immediately cease.

11.3. Effect of Termination

Upon termination of your access to the Services, whether by you or by Stormviax Forecast, all provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Termination will not limit any of Stormviax Forecast's rights or remedies at law or in equity.

12. Governing Law and Dispute Resolution

12.1. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. This means that the laws of India will apply to any disputes arising out of or relating to these Terms or your use of the Services, regardless of your location.

12.2. Dispute Resolution - Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, of India.

  • Arbitration Location: The seat and venue of arbitration shall be New Delhi, India.
  • Arbitrator: The dispute shall be referred to a sole arbitrator appointed by mutual agreement of both parties. If the parties are unable to agree on a sole arbitrator within thirty (30) days of the request for arbitration, the arbitrator shall be appointed in accordance with the rules of the Arbitration and Conciliation Act, 1996.
  • Language: The language of the arbitration shall be English.
  • Confidentiality: The arbitration proceedings and all information exchanged during the course of the arbitration, including any settlement offers, shall be kept confidential by the parties, except to the extent necessary to enforce an arbitration award or as required by law.
  • Award: The arbitral award shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction.
  • Waiver of Class Action: You agree that any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted and you are agreeing to give up the ability to participate in a class action.

12.3. Exceptions to Arbitration

Notwithstanding the foregoing, nothing in these Terms will be deemed to waive, preclude, or otherwise limit the right of either party to:

  • Bring an individual action in small claims court.
  • Pursue an enforcement action through the applicable federal, state, or local agency if that action is available.
  • Seek injunctive relief in a court of law in aid of arbitration.
  • File suit in a court of law to address an intellectual property infringement claim.
